Acceptance of Terms

By accessing or using Performance Analyzer (“the Application”), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this Application.

Use of the Application

This Application is intended for sailing performance analysis. You agree to:

  • Provide accurate information when creating an account
  • Keep your login credentials confidential
  • Use the Application only for lawful purposes
  • Only upload files you own or have the right to upload
  • Not attempt to access data belonging to other users

Uploaded Data

You retain ownership of all GPS track files, instrument data, and other files you upload. By uploading files, you grant us a limited license to process and store them solely for the purpose of providing the analysis service to you. We do not claim any ownership over your uploaded data.

Crew Sharing

When you invite crew members to view your campaign, you are granting them read-only access to your race analyses. You are responsible for ensuring you have appropriate consent from any individuals whose data (e.g. crew names) you include in your analyses.

Intellectual Property

All content in this Application, including the analysis algorithms, interface design, and code, is the property of Performance Analyzer or its respective owners. You may not reproduce or distribute any part of the Application without prior written permission.

Disclaimer of Warranties

This Application is provided “as is” without warranties of any kind. Performance analysis results are estimates based on the data you provide and ORC polar models. We do not guarantee accuracy and results should not be used as the sole basis for racing decisions. The Application may be unavailable at times due to maintenance or technical issues.

Limitation of Liability

Performance Analyzer shall not be liable for any indirect, incidental, or consequential damages arising from your use of this Application or reliance on its analysis results.

Changes to These Terms

We may update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of the Application after changes constitutes acceptance of the revised terms.
